Terms and Conditions, things you need to know before you go

Logging on to this website constitutes your acceptance of the following terms and conditions of use which take effect immediately on your first use of the site. Alpine Expeditions Limited (“Alpine Expeditions”) reserves the right to change these terms and conditions at any time without notice.
This website was updated in May 2003 and the information contained herein is current as from that date, but is subject to change without notice. To ensure that you have the correct and most current information available, please check this website regularly.

Terms and Conditions of Booking:
Alpine Expeditions’ standard conditions of trade are available upon request and will be made available following any expression of interest in booking a tour or package with Alpine Expeditions. All confirmed bookings will be subject to our standard conditions of trade.

Prices:
All prices stated on this website are quoted in New Zealand dollars and include New Zealand Goods and Services Tax (GST). The prices are current as at May 2003, however, Alpine Expeditions reserves the right to change any price quoted without notice. To ensure that you have the correct and most current price list available, please contact Alpine Expeditions.

Minimum Numbers:
Some of the tours and packages detailed on this website require a minimum number of people to make the tour or package viable. Therefore to avoid disappointment please register your interest with Alpine Expeditions as soon as possible so that numbers for tours and packages can be ascertained at an early stage and you can be notified of whether the tour or package will be proceeding.
If a tour or package is unable to take place or is cancelled because it does not have the minimum number of people required, Alpine Expeditions will do all it can to assist you in finding another tour or package suitable to your needs and requirements. However, Alpine Expeditions does not accept any responsibility, financial or otherwise, if you are unable to find an alternative tour or package.

Accommodation:
This website lists the accommodation that Alpine Expeditions uses for the tours and packages. Due to availability at any given time the accommodation may vary from that stated. If the particular accommodation as stated herein is unavailable for any reason, Alpine Expeditions reserves the right to arrange alternative accommodation of an equivalent standard. Please contact Alpine Expeditions if you have any specific requirements regarding accommodation.

Smoking:
It is against the law of New Zealand to smoke in tourist coaches. If smoking is requested, Alpine Expeditions will endeavour to provide regular stops for those who require a smoking break. Please advise Alpine Expeditions of your smoking requirements so that these can be communicated to the accommodation providers and other organisations that Alpine Expeditions operates with. Alpine Expeditions will endeavour to incorporate smoking requirements into its tours and packages if required but cannot guarantee that all requests can be met nor will it accept any liability if requests cannot be met.

Snow, Weather Conditions and Acts of God
Alpine Expeditions will not be liable in respect of any occurrence beyond its control in terms of snow, weather conditions or any Act of God which may impact on the tour or package in any way. No tour or package can be altered once it has commenced. Alpine Expeditions will not refund any monies paid for the tour or package due to delay or postponement of a tour or package, or delay or postponement of activities planned for days on the tour or package. However, if at all possible, Alpine Expeditions will use its reasonable endeavours to make arrangements to do other activities if the planned activities are unable to be undertaken due to snow, weather conditions or Acts of God.

Travel Insurance:
Alpine Expeditions requires you to take out travel insurance for any loss while on a tour or package with Alpine Expeditions. This should include, but is not limited to, insurance for loss of deposit, cancellation fees, loss of luggage and valuables, accidents and health requirements.

Health and Disabilities:
Alpine Expeditions’ tours and packages are designed for people with a moderate level of fitness and ability. Due to the nature of the tours and packages, they are not well suited to disabled persons. If you are not of average health, fitness and ability Alpine Expeditions requires full disclosure of your state of health, medical conditions or any other disability which may impact on your ability to cope with an Alpine Expedition tour or package. Alpine Expeditions reserves the right to refuse your booking if it is not satisfied that it can accommodate your situation. No wheelchair access is available on any tour or package.

Limitation of Liability:
The liability of Alpine Expeditions and any persons associated with it including its officers, agents and employees, is limited to the amount paid by you in respect of your booking of the tour or package.

Exclusion of Liability:
Alpine Expeditions will take all possible steps to ensure you have an enjoyable tour or package. However, Alpine Expeditions accepts no liability for any loss of any kind by any tour members while on the tour or package due to circumstances beyond its control. Such loss may include, but is not limited to, delays or postponement of the tour/package or loss or damage to a person or a person’s property or any other kind of loss whatsoever.
Furthermore, the tours or packages contained on this website may include the services of hotels or other accommodation providers, airlines and other tour operators (“service providers”), none of which are under the direct control of Alpine Expeditions. Alpine Expeditions carefully selects the services it uses, however, it will not be responsible or liable for any loss by a tour member due to the conduct of the service providers or their representatives, agents or employees.

External Websites:
Alpine Expeditions’ website has links to other websites. Alpine Expeditions is not responsible or liable for the content of the external websites.

Computer Viruses:
Alpine Expeditions does not represent or warrant that files attached to this website are free from computer viruses or other defects. Any attached files are provided, and may only be used, on the basis that the user assumes all responsibility for any loss, damage or consequence resulting directly or indirectly from use of the attached files.

General:
If any of the clauses of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any State or Country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that particular clause is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive, remain in full force and effect and continue to be binding and enforceable.

Terms of Trade:
By agreeing to the Terms of Trade all Parties who trade with Alpine Expeditions agree to these terms and conditions.

At Alpine Expeditions maintaining the privacy of any information supplied to us by you is very important. We will take all possible steps to ensure that such information is treated in a confidential manner and in this regard the policy of Alpine Expeditions is set out as follows:

1. Collection of personal information

• Alpine Expeditions only collects personal information from you when it is provided by you. In this regard, the provision of such information is deemed to be authorisation by you for Alpine Expeditions to collect your personal information.

• Alpine Expeditions requires certain personal information (as set out in the booking form) for contact purposes and to ensure that your requirements for any tour or package will be sufficiently met.

• From time to time, Alpine Expeditions may undertake surveys or issue questionnaires for statistical purposes, that will involve the collection of personal information. We will endeavour to provide a link to this privacy policy page for any surveys or questionnaires undertaken. These are entirely voluntary.

2. Recipients of personal information

• In terms of the tours, packages and services Alpine Expeditions provides, some personal information will need to be disclosed to other service providers such as accommodation facilities; airlines and tour operators. However, Alpine Expeditions will not disclose any personal information to any third party without your written authorisation.

3. Access to and correction of personal information
• If Alpine Expeditions holds any personal information about you, you can, at any time, contact us by telephone, facsimile, email or in writing to request a copy of that information held.

• You are able to correct, update or delete any of the information held about you by Alpine Expeditions at any time by contacting us as above.

4. Cookies
• A Cookie is a small amount of data sent to your browser from a web server and stored on your computer's hard drive. It enables you to easily and effectively navigate our website.

• Alpine Expeditions does not use Cookies for the collection of information about users of our website.

5. Storage and security of personal information

• Any personal information collected by Alpine Expeditions will not be held for longer than it is reasonably required for enabling us to provide our services to you.

• The transmission of data over the internet can never be totally secure. Although Alpine Expeditions will always endeavour to protect any personal information you transmit to us by email or our enquiry and customer response form, we cannot guarantee or ensure the security of that information while in transit.

• When personal information is received by Alpine Expeditions, we will use our best endeavours to ensure its security in terms of loss, unauthorised access to, modification or disclosure of or any other misuse and its privacy on our information systems and database.

6. Exclusion of Liability
• Alpine Expeditions accepts no liability for any loss of any kind to any party due to the use of Alpine Expedition's website or any other hyper-linked website, including, but not limited to, loss of profits, business interruption, loss of programs or data on an information handling system or any other loss, even if expressly advised of such possibility.
